1. Introduction

Welcome to Wekadata. This document governs the relationship between you as a user and Wekadata as the provider of a restaurant analytics platform.

By accessing or using Wekadata’s services, you are deemed to have read, understood, and agreed to all terms and conditions stated here. If you do not agree with any part of these terms, you are not permitted to use our services.

We encourage you to read this document thoroughly. If anything is unclear, please contact us before using the service.

2. Definitions

The following terms are used in this document:

  • “Wekadata” refers to the restaurant analytics platform operated by Karhomatul Faqih Al Amin, a legally operating entity under the laws of the Republic of Indonesia, domiciled in Yogyakarta.
  • “User” means the individual or business entity that registers and uses Wekadata’s services.
  • “Service” encompasses all features, dashboards, reports, notifications, and APIs available within the Wekadata platform.
  • “Business Data” means transaction, sales, and restaurant operational data uploaded or synced to the platform by the User.
  • “Account” means the unique access granted to a User after successful registration.

3. Acceptance of Terms

By registering a Wekadata account, you represent that:

  • You are at least 18 years of age, or have legal authority to act on behalf of the business entity you represent.
  • The information you provide during registration is true, complete, and current.
  • You will promptly update your account information if changes occur.

We may update these terms at any time with a minimum of 14 days’ notice before changes take effect, via registered email or in-platform notification. If you do not agree to the changes, you may terminate your subscription before the changes take effect without additional charges. Continued use of the service after changes take effect is considered acceptance of the new terms.

4. User Accounts

4.1 Registration

You must create an account to access Wekadata’s features. One account may be used to manage one or more restaurant branches according to your chosen plan. Each user may only have one active account.

4.2 Account Security

You are solely responsible for the confidentiality of your password and all activities that occur under your account. Wekadata will never request your password via email or any other communication channel. Contact us immediately at support@wekadata.id if you suspect unauthorized access to your account.

4.3 Multi-User Access

For plans that support team access, you may invite team members with different access levels — such as owner, manager, or staff. As the account owner, you are fully responsible for all actions taken by team members you invite.

5. Use of Service

5.1 License

Wekadata grants a limited, non-exclusive, non-transferable, and revocable license to use our service solely for your own restaurant business operations. This license does not cover using the service for third parties’ benefit without written permission from Wekadata.

5.2 Prohibited Activities

You may not use Wekadata’s services to:

  • Violate applicable laws in the Republic of Indonesia.
  • Distribute content that is deceptive, harmful, or infringes third-party rights.
  • Reverse engineer, decompile, or attempt to access the platform’s source code by any means.
  • Use data from the platform for purposes beyond your own business operations, including selling or sharing with third parties.
  • Upload or transmit malicious code, viruses, or destructive software of any kind.
  • Abuse the API or integration systems provided, including making excessive requests that disrupt service stability.
  • Create fake accounts or impersonate another entity.

Violations of these terms may result in account suspension or termination, and in certain cases may be reported to authorities.

6. Data and Privacy

6.1 Ownership of Business Data

The transaction and operational data you enter into the platform remains entirely yours. Wekadata will not sell, rent, or share your business data with any third party without your explicit consent, except as required by applicable law.

You may export all your business data in available formats at any time while your account is active.

6.2 Third-Party Personal Data

For personal data of third parties — such as your restaurant customers’ contact data — Wekadata acts solely as a Data Processor. You are fully responsible as the Data Controller to ensure you have a valid legal basis before entering such data into Wekadata, in accordance with Indonesia’s Personal Data Protection Law (UU PDP).

6.3 Aggregate Data and Post-Subscription Retention

Wekadata may use anonymized and aggregated data for service improvement, internal research, and new feature development. This type of data cannot be used to specifically identify your business.

After account termination or subscription expiry and the 30-day grace period, all data that can identify your business will be permanently deleted. Wekadata may retain fully anonymized data — including transaction patterns, menu categories, and aggregate operational data — for research and service development indefinitely. This retained data cannot be re-associated with your business identity.

6.4 Data Security

We implement industry-standard encryption and security measures to protect your data, including encryption in transit and at rest. However, no system is entirely risk-free. You are advised to always maintain the security of your access credentials and enable two-factor authentication where available.

7. Payment and Subscriptions

7.1 Plans and Pricing

Wekadata offers several subscription plans to suit your business needs, from Free to Enterprise. Prices and feature details for each plan are listed on the Pricing page and may change with prior notice.

7.2 Billing Cycle

Subscriptions are billed monthly or annually according to your choice at registration. Annual payment receives a lower price compared to monthly payment.

7.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period, unless you cancel at least 3 days before the renewal date. We will send a reminder via email 7 days before the renewal date so you have sufficient time to review or cancel.

7.4 Refund Policy

Paid subscription fees are non-refundable, except:

  • Required by applicable law in Indonesia, or
  • A significant service outage caused by Wekadata lasting more than 72 consecutive hours in a single billing period, in which case you are entitled to request a prorated refund for the affected period.

Refund requests may be submitted to support@wekadata.id with your account details and the period in question.

8. Service Termination

8.1 Termination by User

You may cancel your subscription at any time through your account settings or by contacting our team. Access to the service remains until the end of the paid billing period. After that, your account enters read-only mode for 30 days, during which you may still view and export data. After 30 days, data that can identify your business will be permanently deleted.

8.2 Termination by Wekadata

Wekadata may suspend or terminate an account under the following circumstances:

  • Non-critical violations of the terms of use — we will provide notice and a 7-day opportunity to remedy before further action is taken.
  • Serious violations, indications of fraud, or service abuse — termination may occur immediately without prior notice.
  • Repeated payment failures after multiple attempts — account will be suspended until payment is successfully resolved.

In cases of termination due to violations, Wekadata is not obligated to provide a refund.

9. Limitation of Liability

Wekadata’s services are provided “as is” without any warranty. We do not guarantee that the service will always be available without interruption or entirely free of technical errors.

Wekadata is not responsible for:

  • Indirect, incidental, or consequential losses arising from use or inability to use the service.
  • Data loss due to user error, device failure, or system disruptions beyond our control.
  • Business decisions made based on data, reports, or recommendations from the platform.
  • Service disruptions caused by third parties, including cloud infrastructure providers or internet connections.

Wekadata’s total liability to you for all claims arising shall not exceed the amount you paid to Wekadata in the 12 months prior to the claim.

10. Changes and Service Discontinuation by Wekadata

Wekadata may modify, restrict, or discontinue certain service features at any time for maintenance, improvement, or strategic adjustment purposes. For changes that are material and affect core service functionality, we will provide at least 30 days’ notice.

If such changes significantly reduce the value of the service you are paying for, you may request a prorated refund for the unused portion of the billing period.

11. Force Majeure

Wekadata is not responsible for failures or delays in service provision caused by events beyond our reasonable control, including but not limited to:

  • Natural disasters or extreme weather.
  • Internet infrastructure or third-party network failures.
  • Large-scale cyberattacks such as DDoS.
  • Officially declared pandemics or outbreaks.
  • Government policies or regulations impacting service operations.

In force majeure conditions, we will endeavor to provide regular status updates and restore service as quickly as possible.

12. Governing Law and Dispute Resolution

These terms and conditions are governed by and interpreted in accordance with the laws of the Republic of Indonesia. Any disputes arising from or related to these terms will first be resolved through mutual deliberation. If agreement is not reached within 30 days of the dispute being reported in writing, the dispute will be resolved exclusively through the Yogyakarta District Court.

13. Miscellaneous

  • Severability: If any provision in these terms is deemed invalid or unenforceable, it will be modified as necessary, and the remaining provisions remain in full effect.
  • No Waiver: Wekadata’s failure to enforce any right or provision in these terms shall not be considered a waiver of that right or provision.
  • Entire Agreement: This document, together with the Privacy Policy, constitutes the entire agreement between you and Wekadata regarding use of the service.
